The following outlines the terms and conditions (“Terms of Sale”) that applies to orders you place on the West Coast Brewery website (“Website”). West Coast Brewery (“WCB”) is a trading division of Coastwest Holdings Ltd. These terms and conditions will be deemed to have been read and understood and agreed upon by placing an order. If you do not agree with these terms and conditions, then you must stop using and accessing the Website.
When you order through the Website, WCB requests information from you to complete your order, including contact information (i.e., shipping address).
Payment details will be gathered by Stripe Payment Gateway, for the purpose of paying for your order with WCB. This information remains with Stripe. With the exception of identifying information provided by Stripe when payment is received, no financial information such as credit card numbers etc is transmitted.
Any information that is gathered as part of the ordering process will be maintained confidentially by West Coast Brewery and will not be sold or shared with any other parties under any circumstances.
The order total includes the price of the product, delivery costs (where applicable) and GST.
Prices displayed on this Website may vary to the prices displayed by independent stockists of WCB products.
Acceptance of orders placed with WCB via the Website is conditional on the verification of received payment. All transactions are in New Zealand dollars.
Delivery days are available Monday through to Friday. No deliveries are made on public holidays or on those days where it is prohibited to sell alcohol.
Orders will be dispatched immediately on confirmation of received payment and an email sent advising when goods are on the way. Tracking details will also be provided, including the site on which to check the progress of your delivery.
WCB utilizes PBT Couriers to deliver our products and as such, delivery will be made in accordance with PBT Courier’s terms of service.
WCB will endeavour to have all normal orders delivered within a reasonable time frame, however delays may occur if payment is delayed or additional requests are made once the initial order has been placed.
You warrant and understand that it is your responsibility to provide WCB with identification to confirm the age of the person ordering. We accept current Drivers Licences with photo ID and HANZ 18+ Cards. The identification must include:
- Full Name (must match the name of the person ordering)
- Date of Birth
- A photo
- A signature
In New Zealand, it is against the law to leave restricted goods such as alcohol unattended at an address, and therefore if no one is available to receive the goods, the courier will leave a card to call. A pick up or new delivery time can be arranged directly with the courier.
Any questions can be made directly to WCB.
If the goods cannot be delivered for any reason, such as you or the recipient failing or refusing to accept the goods, the goods will be returned to WCB awaiting further instruction. Note that a further delivery cost will be incurred in this case.
WCB will be deemed to have fulfilled its obligations under the order on delivery of the goods.
There are different costs associated with delivery depending upon location. The cost zoning is set by PBT Couriers and on-charged by WCB.
If you are unhappy with any aspect of your delivery or would like to return any part of your order, please contact WCB directly with details of your order and to discuss what is required.
No refunds will be given for ‘over-ordering’.
WCB does not have a ‘change of mind’ policy.
Return of goods is reliant on a quality issue associated with the goods.
Claims to return for refund must be made within seven days of receipt of the goods.
The cost of the return of the goods will be paid for by you. WCB will not be responsible for the costs of couriered goods for the purpose of a return/refund.
WCB reserves the right to refuse a refund on goods.
Warranties and Liabilities
Subject to the Consumer Guarantees Act 1993, and otherwise to the maximum extent permitted by law, WCB expressly excludes all express or implied warranties, descriptions, representations, statements and advice given as to the fitness or suitability for any purpose, tolerance to any conditions, similarity to sample, merchantability or otherwise. Subject always to the Consumer Guarantees Act 1993 and otherwise to the maximum extent permitted by law, WCB shall not be bound or responsible for any such unauthorised warranties; and/or descriptions; and/or representations; and/or statements; and/or advice, made by any of its employees, agents, suppliers or delivery people, whether made in good faith or otherwise.
If you are not a “Consumer” as defined in the Consumers Guarantees Act 1993 or where you hold yourself out as acquiring the goods for the purposes of business, then the provisions of the Consumer Guarantees Act 1993 shall not apply.
You accept and acknowledge the regardless of any advice given by an employee, agent, supplier or delivery person, that upon acceptance of the goods by you or the Recipient, all risk in the goods passes to you. Title in the goods passes to you once you have paid for the goods in full.
Subject always to the Consumer Guarantees Act 1993, and otherwise to the maximum extent permitted by law, WCB excludes all liability against any damage and/or injury and/or loss arising directly or indirectly from any defect in or non-compliance of the goods. You acknowledge and accept that any damages for any other breach of WCB’s obligations shall not in any event exceed an amount equivalent to the price of the goods you have paid for.
You accept and acknowledge that WCB is not liable or responsible for any damage and/or injury and/or loss arising from the servants, agents, buyers, Recipient or any other persons.
WCB shall be under no liability to you in respect of anything that, if not for this provision, would or might constitute a breach of the Terms, where this arises out of circumstances beyond the control of WCB, including but not limited to acts of God; natural disasters; sabotage; accident; riot; shortage of supplies; equipment, materials; strikes and lockouts; civil commotion; computer hacking; or malicious damage.
Privacy & Personal Information
Exceptions to the withholding of private and personal information, are in the event of the requirement of seeking the services of a credit recovery agent; or information has been requested by the relevant authorities such as law enforcement for the purposes of an investigation.
Account, delivery, payment and personal details with otherwise be dealt with in accordance with all relevant privacy laws applicable in New Zealand.
